Human Rights Without the Right to Democracy in West Papua

Doc: Ist/The Phenomenon of Silencing the Democratic Space. (Human Rights Without the Right to Democracy in West Papua)

World Human Rights Day is celebrated on December 10 every year. Commemoration of Human Rights Day (HAM) is carried out all over the world, including in Indonesia.

Commemoration of Human Rights Day coincides with the Universal Declaration of Human Rights (UDHR) by the United Nations (UN) Assembly on December 10, 1948.

Human Rights Day is celebrated worldwide every December 10, especially to celebrate the starting point of human awareness about the importance of recognizing basic human rights everywhere.

Indonesia has Big Homework to resolve a series of Serious Human Rights Violations in West Papua.

A Series of Human Rights Violations in West Papua (2007-2022)

The National Human Rights Commission (Komnas HAM) officially recorded six cases of human rights violations in Papua that occurred from 1998 to 2017:

Bleeding Biak Case July 1998, Wasior Case Bleeding June 2001, Wamena Case Bleeding April 2003, Cenderawasih Jayapura University Case March 2006, Paniai Case Bleeding December 2014, Oneibo Case August 2017, The Shooting of Pastor Yeremias Zanambani September 19 2020, Rufinus Tigau October 26 2020, Shooting of Two Small Children in Diamond October 26 2021, Shooting of Mama Agustina Ondou November 9 2021, Case of Mutilation in Timika August 22 2022.

The series of cases of human rights violations above have yet to meet a plenary, final, democratic, humane and just settlement process.

There was only one case that was successfully processed by law, but through, within and by the Concept and Legal Mechanism of the Unitary State of the Republic of Indonesia which was full of engineering, manipulative, distorted and one-sided, namely the Bloody Paniai Case.

The motive and mode of resolution of the Bloody Paniai Serious Human Rights case is so that the Paniai Case becomes a sample or example of a case of gross human rights violations that was successfully resolved by, within and through Indonesian (national) legal concepts and mechanisms, without taking the path of international human rights law concepts and mechanisms (High Commissioner UN Human Rights Council).

The Bloody Paniai Case was also chosen because the Bloody Paniai Case does not have direct contact with the issue of the political status of the West Papuan people.

That in the Paniai gross human rights violation case there was no political content for Free Papua, it was purely a human rights violation case, while other gross human rights violation cases such as bloody Biak, bloody Abepura, bloody Uncen, bloody Wamena, bloody Wasior, bloody Intan Jaya and bloody Nduga were contained elements of the Issue of West Papua's Political Status.

So it is very unlikely to be resolved, but now based on the experience of the Paniai Case settlement process, all of these cases will be slowly resolved by the state using the domestication or nationalization of West Papua's Human Rights Customers to avoid intervention from the global community (foreign parties), for example, the High Commissioner of the UN Human Rights Council.

Human Rights Without Democratic Rights in West Papua

The Republic of Indonesia's Security Forces (POLRI) really want to implement the controversial article in the newly passed RKUHP or not. It's still a hot debate, but it's a different story in West Papua, World Human Rights Day on Saturday, December 10, 2022 is marked by the phenomenon of silencing critical and crystallized space for democracy and reform.

There were ambushes, beatings, arrests, detentions, imprisonment, harassment and mass pursuit. Actions from students and Papuan people demanding answers to justice, truth and peace against the Sentrum captain of power in Jakarta were brutal, fatal, frontal and radical.

"Police of the Republic of Indonesia Perform Forced Dispersal, Beating, Arrest and Chase"

Today, Saturday 10 December 2022 the Papuan people under the Student Command and KNPB are carrying out an Action to commemorate Human Rights Day in the district and city of Jayapura.

At the Expo point, Perumnas III Waena and Perumnas II to be exact in front of the Mimika Dormitory, the Republic of Indonesia Police dispersed the demonstrators by means of violence. At these points, the Beating and Pursuit of the Mass Action took place.

Some of the mass action was chased by the police of the Republic of Indonesia to the top of the camping ground hill (Buper).

Additional Information:

First, you can see in the photo below, a number of protesters who were being chased reached the hills of Buper.

Second, a photo of a bleeding wound on the left neck as a result of being hit by the Indonesian National Police.

More or less, that is one of the chronologies of the phenomenon of silencing the democratic space in West Papua. That there was a brutal, fatal, radical and frontal militaristic restriction on the Democratic Rights of the West Papuan people by the State.

Some Affirmations

First, there needs to be a fair, humane and democratic settlement of cases of gross and minor human rights violations in West Papua based on international legal concepts and mechanisms. That the West Papua Human Rights Violations Case must be advocated for and investigated by the Commissioner of the UN High Council for Human Rights.

Second, please advocate and investigate several students and civil society who were detained by security forces from legal aid and human rights institutions.

Third, by silencing the democratic space on World Human Rights Day, in fact Indonesia itself has declared and proclaimed that the Unitary State of the Republic of Indonesia is an ANTI HAM, DEMOCRACY, Dictatorial, Authoritarian and Conservative Country.

Fourth, by limiting the realization of the Democratic Rights of the West Papuan people, Indonesia has become a country that is only diligent in ratifying the UN legal and human rights instruments and charter, but is extremely slow and slow to realize respect for, respect for and upholding human rights in West Papua.

Fifth, Indonesia has become a “Nation of West Papuan Human Rights Killers” on World Human Rights Day. This is a crazy record from the perspective of law, human rights and democracy, especially in the philosophy of Pancasila which greatly admires the human rights of every citizen. Indonesia is already very capitalist, colonialist and imperialist over Papua.

Sixth, finally, the Jokowi regime during these two periods was nothing more than a serious emergency for gross human rights violations in West Papua, which is not very different from the Suharto regime. That Jokowi's regime can be called the Neo-Soehartorism Regime or the Suharto Regime Volume II.

On this World Human Rights Day, the Jokowi regime received a red report card from the people of West Papua who have not experienced Truth, Justice and Peace from the perspective of appreciation, respect and upholding human rights and reform democracy during Jokowi's two periods, volume II.

Hopefully on this World Human Rights Day there is a glimmer of hope that will arise with respect, respect and upholding human rights in West Papua through, within and by the Concept and Mechanism of International Law and Justice (UN Human Rights Summit. (*)
